Agreement to Terms
These Terms of Service govern your use of all products and services provided by AVS ISP. By creating an account or using our services, you agree to comply with and be bound by these Terms.
We respect your privacy, your data, and your freedom online. In return, we expect all customers to use our network responsibly and lawfully.
VPS & VDS Services
Our VPS and VDS services provide virtualized server resources with full administrative access. You are solely responsible for all configurations, software management, security, and data on your server.
Unmanaged Services: All services are provided unmanaged. We maintain the underlying physical infrastructure and hypervisor systems, but we do not maintain your operating system, installed software, or configurations. Security patches, updates, and software management are your responsibility.
DDoS Protection
We provide DDoS mitigation for all services. While we make every reasonable effort to mitigate attacks and maintain service availability, we cannot guarantee 100% effectiveness as attack methods continuously evolve.
DDoS protection is provided on a best-effort basis. We respond promptly to attacks and deploy appropriate countermeasures, but protection effectiveness depends on attack complexity, volume, and traffic patterns.
Bandwidth & Network Usage
Unmetered Bandwidth: You are not billed based on data transfer volume. Traffic is still kept track of for abuse monitoring - but you are not billed based on usage.
Fair Use Policy: While bandwidth is unmetered, extreme or abusive usage that degrades network quality or impacts other customers may result in rate limiting. Continuously saturating your allocated port at maximum capacity is not permitted and may result in bandwidth limitation, service suspension, or termination.
Account Credits
Credits added to your account represent a virtual balance for service purchases and renewals. Account credits are non-refundable, non-transferable, and cannot be withdrawn as cash. They are shown as a monetary value equivalent for simplicity of usage - but are not representative of "fiat" currency. We are not a licensed e-money service or bank.
Data Backup Responsibility
You are solely responsible for maintaining backups of your data. We strongly recommend implementing regular automated backups stored off-server. We are not responsible for any data loss, regardless of cause.
Service Availability & Warranties
Our services are provided "as-is" and "as-available." While we maintain high reliability standards, we make no warranties beyond those outlined in our Service Level Agreement (SLA).
Limitation of Liability: We are not responsible for:
- Data loss or corruption from any cause
- Service interruptions caused by third-party providers, network issues, or force majeure events
- Indirect, incidental, or consequential damages including lost profits, revenue, or business opportunities
- Damages resulting from unauthorized access, security breaches, or software vulnerabilities
Acceptable Use
You may not use our services for any illegal activity, or to host, transmit, or distribute content that violates applicable laws. Prohibited activities include but are not limited to:
- Distribution of malware, viruses, or malicious software
- Network attacks, port scanning, or unauthorized access attempts
- Spam, phishing, or fraudulent activities
- Copyright infringement or distribution of pirated content
- Child exploitation material of any kind
Violation of acceptable use policies may result in immediate service suspension or termination without refund.
Prohibited Services & Activities
The following services and activities are strictly prohibited on our network:
- Tor Nodes: Operating Tor exit nodes or relay nodes is not permitted - traffic to and from the Tor network may be blocked by reasonable measures
- Public Proxies: Hosting public proxy services (HTTP, SOCKS, etc.) accessible to the general public
- Public VPN Services: Operating commercial or public VPN services for third-party users
- Open DNS Resolvers: Running publicly accessible DNS resolvers that can be abused for amplification attacks
- Cryptocurrency Mining Pools: Operating public mining pools or mining services
- File Sharing Networks: Public torrent trackers or file sharing sites hosting pirated content
- Botnet Command & Control: Any infrastructure related to botnets or malware distribution
- DDoS-for-Hire Services: Stresser, booter, or DDoS attack services
Personal Use Exception: Private VPN servers for your own personal use and private proxies for your own applications are permitted, so long as they are secured and not offered to others for use - whether for profit or otherwise. The distinction is between public services accessible to others versus private tools for your own infrastructure.
Violation of these prohibitions may result in immediate service suspension or termination without prior notice.
Account Suspension & Termination
We reserve the right to suspend or terminate services for violation of these Terms, non-payment, abuse of resources, or illegal activity. In cases of termination for policy violations, no refunds will be issued.
KYC & Traffic Logging
We explicity guarantee herein that we will not request customer to provide any KYC data other than email address and name as required to open an account. We also expressly note that we DO NOT monitor customer's traffic, except to the extent needed to provide the services.
Changes to Terms
We may update these Terms to reflect service changes, legal requirements, or operational improvements. Updated Terms will be posted on this page with a revised date. Continued use of our services constitutes acceptance of any changes.
